Terms and Conditions – Starfod

Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
- Ancillary Contract: An additional agreement under which the Consumer purchases products, digital content, or services related to a Distance Contract, supplied by Starfod or a third party under an arrangement with Starfod.
- Grace Period: The period during which the Consumer may exercise their right of withdrawal.
- Consumer: A natural person acting outside of a trade, business, or profession who enters into a contract with Starfod.
- Day: A calendar day.
- Digital Content: Data or materials produced and supplied in digital form.
- Ongoing Contract: An agreement that covers repeated or continuous delivery of products or services over time.
- Durable Medium: Any medium that enables the Consumer or Starfod to store information in a manner accessible for future reference and unaltered reproduction, including electronic mail.
- Right of Withdrawal: The Consumer’s right to cancel a Distance Contract within the Grace Period.
- Model Form: The standard withdrawal form provided by Starfod for Consumers who wish to exercise their right of withdrawal.
- Entrepreneur / Starfod: The legal entity offering products, digital content, and/or services remotely to Consumers.
- Distance Contract: An agreement formed through Starfod’s online or digital system without face-to-face interaction between Starfod and the Consumer.
- Means of Distance Communication: Any method used to conclude a Distance Contract without both parties being physically present at the same time.
- General Terms and Conditions: These Terms and Conditions as set forth by Starfod.

Article 3 – Applicability
- These Terms and Conditions apply to every offer made by Starfod and to all Distance Contracts and transactions between Starfod and Consumers.
- Before a Distance Contract is concluded, the text of these Terms and Conditions will be made available to the Consumer. If not feasible, Starfod will provide information on where the Terms can be accessed electronically and will send a copy free of charge upon request.
- For electronically concluded contracts, these Terms will be provided in a format that allows the Consumer to save and reproduce them.
- If additional terms apply to specific products or services, both these and the present Terms apply. In case of conflict, the Consumer may rely on the more favorable provision.
- If any clause in these Terms is declared invalid, the remaining provisions remain effective. The invalid provision will be replaced with one closest in meaning to the original.
- Any ambiguities in interpretation shall be resolved consistent with the intent of these Terms and Conditions.
Article 4 – The Offer
- If an offer has limited validity or is subject to specific conditions, this will be clearly stated.
- All offers made by Starfod are non-binding and may be adjusted or withdrawn at any time.
- Starfod strives to provide accurate descriptions and visual representations of all products and services offered. Minor discrepancies or typographical errors do not constitute grounds for claims.
- Product images are intended for illustration purposes and may vary slightly from actual items.
- Each offer includes sufficient details for the Consumer to understand their rights and obligations, including total price including applicable taxes; shipping costs; steps necessary to conclude the contract; whether or not the Right of Withdrawal applies; payment, delivery, and performance terms; and any applicable duration or renewal conditions.
Article 5 – The Contract
- The contract is formed once the Consumer accepts the offer and fulfills any stated conditions.
- When a contract is made electronically, Starfod will acknowledge receipt promptly. Until this confirmation is received, the Consumer may withdraw their acceptance.
- Starfod maintains secure technical and organizational measures for data transmission and electronic payments.
- Starfod reserves the right, within legal limits, to verify a Consumer’s payment capability before confirming an order. If warranted, Starfod may refuse or conditionally approve an order.
- Upon conclusion, Starfod will provide the Consumer with the company’s contact details for complaints; conditions and process for exercising the Right of Withdrawal; warranty information and after-sales support; price and delivery information; and the model withdrawal form (if applicable).
Article 6 – Right of Withdrawal
Products: Consumers may cancel purchases within 30 days of receiving the product, without giving a reason. For multiple items, the period begins once all items are received. The Consumer must handle the product carefully and only inspect it as necessary.
Services and Digital Content: For digital content not supplied on a tangible medium, or for services, the Consumer may withdraw within 14 days from contract conclusion.
Extended Withdrawal: If Starfod fails to provide required information about the Right of Withdrawal, the withdrawal period extends to 12 months from the end of the original period.
Article 7 – Costs of Withdrawal
The Consumer bears the cost of returning the goods unless the product is defective or incorrectly delivered. Starfod will refund the purchase amount within 10 business days of receiving the returned goods or proof of shipment, using the same payment method originally used. Any depreciation due to improper handling will be deducted from the refund amount.
Article 8 – Exclusion of the Right of Withdrawal
Withdrawal rights do not apply to: custom-made products; perishable goods; goods with broken hygiene seals; newspapers or magazines; digital products or software once opened; services completed before the end of the withdrawal period with Consumer consent.
Article 9 – Prices
Prices will not change during the validity of an offer unless required by law (e.g., UK VAT changes). Variable pricing may apply for items influenced by market fluctuations, clearly indicated as such. All prices are listed in GBP and exclude import duties or VAT. Starfod is not liable for typographical or pricing errors.
Article 10 – Warranty and Conformity
Starfod guarantees that its products and services conform to the contract and applicable standards of quality, reliability, and safety. Consumers must report defects within 4 weeks of receiving the goods. The warranty does not apply if products have been altered, misused, or improperly handled by the Consumer.
Article 11 – Delivery and Fulfillment
Starfod will handle orders with care and deliver to the address provided by the Consumer. Orders are typically processed within 1–3 business days and delivered within 5–7 business days. If a delay occurs, the Consumer will be informed and may cancel the order if it exceeds 30 days. Risk transfers to the Consumer upon delivery. In the event of size discrepancies, Starfod will assist with exchanges or returns.
Article 12 – Duration, Termination, and Renewal
The Consumer may terminate ongoing contracts at any time with one month’s notice. Fixed-term contracts cannot be automatically extended beyond their initial term without Consumer consent. Contracts lasting over one year may be terminated after the first year with one month’s notice.
Article 13 – Payment
Payments must be made within 7 business days after the contract is finalized unless stated otherwise. Consumers are responsible for providing accurate payment information. In case of non-payment, Starfod may recover reasonable costs associated with collection.
Article 14 – Complaints Procedure
Complaints should be submitted in writing to contact@starfod.com with a full description of the issue. Starfod will respond within 3 days. If more time is required, Starfod will notify the Consumer of the expected timeline. If no mutual resolution is possible, the dispute will proceed under the applicable UK jurisdiction.
Article 15 – Governing Law
These Terms and all agreements between Starfod and the Consumer are governed exclusively by the laws of England and Wales.
Article 16 – Additional Provisions
Any additional or alternative clauses must not disadvantage the Consumer and must be provided in writing or on a durable medium.
Article 17 – Acceptance of Replacement Items
When a Consumer accepts a free replacement (such as a different size), they forfeit the right to return the replacement item, as the initial cost has already been absorbed by Starfod.
Article 18 – Payment Obligation
By placing an order, you agree to these Terms and confirm your obligation to pay. A refund or chargeback from a payment provider does not nullify this obligation. Starfod reserves the right to reclaim payments reversed without valid reason.
Article 19 – Reshipment Rights
Starfod reserves the right to resend products if an error occurred in shipment, if an item was defective, or if a return was incorrectly processed.
Article 20 – Promotional Offers
All promotional offers are non-binding and may be withdrawn or altered at any time. Each offer includes clear details on price, duration, payment methods, and applicable terms.
Article 21 – CESOP Compliance
Under the Central Electronic Payment Information System (CESOP) regulations implemented in 2024, payment service providers may record and report relevant transaction data to European authorities for compliance purposes.
